In Belgium our Criminal Law procedure is still (and remains) based on the "Code d'Instruction Criminelle" from 1808 by Napoleon. Many attempts to reform this code have failed. In the near future the government bill "Franchimont" will be approved. For the criminal jurist, this government bill will be the biggest turn over which they are anticipating for a very long time now. Due to this government bill they expect to have to their disposal a corpus of rules of law. These rules, on the one hand, must consist in modern rules concerning the Rights of defence and, on the other hand, it must be possible to apply those rules to punish new forms of delinquency.
